Lawsuits: Second Hand Smoke


A fellow in Florida, arrested for disorderly conduct, later sued the police department for "endangerment" to his person during the transport to jail and the half-hour he spent there before being bailed out. What was the endangerment? Exposure to "second hand smoke." Amazingly he won his case, but the jury was far from overly sympathetic. He was awarded $7.50 in damages. His case was majorly weakened becasue he was a bartender in a bar that allowed smoking and he lived with a woman that smoked.
